Terms of Service

1. Purpose
These Terms of Service (the “Terms”, also referred to in French as “CGU”) govern the use of the Jamodio service (the “Service”), an online platform allowing musicians to create real-time remote jam sessions, published by Benoît Godard (see Legal notice).
Use of the Service implies full and unreserved acceptance of these Terms. If you do not accept these Terms, you must not use the Service.
2. Access to the Service
2.1 Registration
Access to the Service requires the creation of a user account (email + password). You undertake to provide accurate information and to keep it up to date.
The Service is accessible from the age of 15. Younger users must obtain the consent of a holder of parental authority.
2.2 Required equipment
You are responsible for having the necessary equipment: a computer with a recent browser (Chrome, Firefox, Safari, Edge), a stable Internet connection (wired Ethernet recommended), wired headphones (Bluetooth introduces prohibitive latency), optionally an external audio interface, and the native Jamodio Audio Engine agent for minimum latency.
2.3 Availability
The Service is in beta phase. No guarantee of availability, data integrity or performance is provided at this stage. Interruptions, for maintenance or due to force majeure, may occur without notice.
3. Acceptable use
By using the Service, you agree to:
- comply with applicable laws and regulations;
- respect the rights of others (copyright, privacy, dignity);
- not use the Service to disseminate illegal, hateful, discriminatory, pornographic or child sexual abuse content;
- not disrupt the operation of the Service (attacks, flooding, exploitation of vulnerabilities);
- not impersonate any third party;
- not collect personal data on other users without their consent.
In the event of a breach, access may be suspended or terminated without notice, without prejudice to any judicial proceedings.
4. Musical content and copyright
The Service allows you to upload backing tracks, record sessions and share real-time audio/video streams.
You remain solely responsible for the content you use or broadcast on the Service. You warrant that you hold the necessary rights to exploit the works you upload (original compositions, covers with a license, works in the public domain, works under a free license, or strictly private use).
Use of works protected by copyright without authorization from the rights holder — including in the private context of a remote rehearsal — may constitute infringement. If in doubt, consult your national collecting society (in France, the SACEM).
5. Intellectual property
5.1 Your content
You retain all rights to the recordings and musical productions you create through the Service. Jamodio claims no exploitation rights over such content, does not resell it, does not share it with third parties without your authorization, and does not retain it on its servers beyond what is strictly necessary for the operation of the current session.
The recordings you make are downloaded directly to your browser. They are not stored on Jamodio's servers.
5.2 Service content
The visual identity, code, texts, icons and all components of the Service remain the exclusive property of the publisher. Any unauthorized reproduction or reuse is prohibited.
6. Personal data
The processing of personal data is detailed in our Privacy policy, which forms an integral part of these Terms.
7. Reporting illegal content & DSA obligations
In accordance with Regulation (EU) 2022/2065 on a Single Market For Digital Services (Digital Services Act, DSA), applicable since 17 February 2024, Jamodio provides the following mechanisms.
7.1 Single point of contact
In accordance with Articles 11 and 12 of the DSA, Jamodio designates as single point of contact for competent authorities and for users: contact@jamodio.com — accepted languages: French, English.
7.2 Reporting illegal content (Art. 16 DSA)
If you notice content hosted on Jamodio (a recording, backing track, studio name, profile picture…) that appears manifestly illegal (infringement, hateful content, copyright violation, child sexual abuse material, etc.), you may report it to contact@jamodio.com specifying:
- the exact URL or identifier of the content concerned;
- a precise description of the grounds for illegality;
- the legal basis or rights invoked;
- your contact details (name, email) and a good-faith statement.
The publisher reviews each report within a reasonable time (target: 48 business hours), takes appropriate measures (removal, disabling access, suspending the relevant account) and informs the reporter and the affected user of the reasoned decision.
7.3 Internal complaint-handling mechanism (Art. 20 DSA)
If you are affected by a content moderation decision (removal, account suspension, demotion…), you may challenge that decision by writing to contact@jamodio.com within 6 months of the decision. A reasoned response will be provided within 14 business days.
8. Liability
8.1 Limitation of liability
The Service is provided “as is”, with no guarantee of results. The publisher cannot be held liable for:
- interruptions of the Service, whatever the cause;
- data loss linked to a malfunction of the user's browser or network;
- perceived audio/video quality, which depends on each musician's connection and equipment;
- use made by users (content, in-session behaviour…);
- indirect damages (loss of business, loss of opportunity, reputational harm).
8.2 Force majeure
The publisher shall not be liable in the event of force majeure within the meaning of Article 1218 of the French Civil Code (general Internet outage, failure of major technical providers, administrative decisions, etc.).
9. Termination
You may delete your account at any time from the Service interface (Settings → Delete my account) or by writing to contact@jamodio.com. Deletion is immediate and irreversible.
The publisher reserves the right to suspend or terminate a user's access in the event of a serious breach of these Terms, without notice or compensation.
10. Changes to the Terms
These Terms may be amended at any time to reflect changes in the Service or in regulations. The last update date appears at the top of the page. For any substantial modification (in particular the transition to a commercial version), active users are notified by email at least 15 days before entry into force.
11. Governing law and disputes
These Terms are governed by French law. In the event of a dispute, the parties shall seek an amicable solution before any legal action. Failing agreement, the French courts shall have exclusive jurisdiction, subject to mandatory consumer protection rules.
In accordance with Article L.612-1 of the French Consumer Code, you may have recourse to a consumer mediator in the event of an unresolved dispute. The mediator's details will be communicated upon request to contact@jamodio.com as soon as the Service enters its commercial phase (outside the private beta phase).
This page is provided in English for convenience. The French version prevails in case of any discrepancy.
